Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of Aisle Kit's website and client portal service (the "Service") provided by Aisle Kit Pty Ltd ("Aisle Kit", "we", "us", or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
Description of Service
Aisle Kit provides a client portal platform for wedding planners to manage guest lists, RSVPs, digital invitations, and day-of timelines for their clients. The Service includes:
- Branded client portals for wedding couples
- Guest list and RSVP management tools
- Digital invitation creation and distribution
- Day-of timeline creation and sharing
- Vendor directory management
Account Registration
To use the Service, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorised access
Subscription and Payment
Billing
Subscriptions are billed monthly in Australian Dollars (AUD). By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.
Free Trial
We offer a 14-day free trial for new accounts. No payment is required during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged.
Price Changes
We reserve the right to modify pricing with 30 days' notice. Price changes will not affect your current billing cycle.
Refunds
Subscription fees are non-refundable except where required by Australian Consumer Law. If you cancel mid-cycle, you retain access until the end of your paid period.
Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit harmful code, spam, or malicious content
- Attempt to gain unauthorised access to our systems
- Interfere with or disrupt the Service
- Collect user information without consent
- Use the Service for any purpose other than its intended wedding planning use
Your Content
Ownership
You retain ownership of all content you submit to the Service ("Your Content"), including wedding details, guest lists, and customisations.
License
By submitting content, you grant us a limited license to use, store, and display Your Content solely to provide the Service to you and your clients.
Responsibility
You are solely responsible for Your Content and ensuring you have the right to share any information you upload, including guest information provided by your clients.
Intellectual Property
The Service, including its original content, features, and functionality, is owned by Aisle Kit and protected by copyright, trademark, and other intellectual property laws.
Our name, logo, and all related names, logos, and slogans are our trademarks. You may not use these without our prior written permission.
Third-Party Services
The Service may integrate with or contain links to third-party services. We are not responsible for third-party content, privacy policies, or practices. Your use of third-party services is at your own risk.
Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue the Service (or any part) at any time with reasonable notice.
Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
Limitation of Liability
To the maximum extent permitted by Australian law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, special, or consequential damages
- Our total liability is limited to the amount you paid us in the 12 months preceding the claim
These limitations do not affect your rights under Australian Consumer Law where applicable.
Indemnification
You agree to indemnify and hold harmless Aisle Kit and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, Your Content, or your violation of these Terms.
Termination
By You
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period.
By Us
We may suspend or terminate your account immediately if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Fail to pay subscription fees
Effect of Termination
Upon termination, your right to use the Service ceases immediately. We may retain Your Content for a reasonable period to allow data export. After this period, Your Content may be permanently deleted.
Dispute Resolution
These Terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria, Australia, unless otherwise required by law.
Before initiating formal proceedings, you agree to attempt to resolve any dispute by contacting us at legal@aislekit.com.au.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect.
Continued use of the Service after changes constitutes acceptance of the modified Terms.
General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Aisle Kit regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Our failure to enforce any right or provision does not waive that right.
- Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations at any time.
